These Terms of Service ("Terms") govern your use of Umbra, a dream journal and AI-powered interpretation service operated by Murray Digital LLC ("Umbra," "we," "us," or "our") at umbrajournal.com.
By creating an account or using Umbra, you agree to these Terms. If you do not agree, do not use the service.
1. Umbra Is Not Therapy
This is the most important section of these Terms.
Umbra is a self-exploration and personal growth tool. It is not a substitute for professional mental health care, psychological counseling, therapy, or medical advice.
- Umbra's AI-generated dream interpretations are produced by artificial intelligence, not licensed therapists, psychologists, or medical professionals.
- Interpretations draw on Carl Jung's analytical psychology as a framework for self-reflection. They are not clinical diagnoses or treatment recommendations.
- If you are experiencing a mental health crisis, suicidal thoughts, or psychological distress, please contact a qualified mental health professional or crisis service immediately. In the United States, you can reach the 988 Suicide & Crisis Lifeline by calling or texting 988.
- Do not rely on Umbra's interpretations to make medical, legal, or other consequential life decisions.
- Umbra does not establish a therapist-patient, doctor-patient, or any other clinical relationship with you.
By using Umbra, you acknowledge that you understand and accept these limitations.
2. Eligibility
You must be at least 16 years old to use Umbra. By creating an account, you represent that you meet this age requirement.
3. Your Account
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide a valid email address and keep it current.
- One account per person. Do not share accounts or create multiple accounts.
- We may suspend or terminate accounts that violate these Terms.
4. Subscription Plans and Billing
Plans
Umbra offers the following subscription tiers:
- Free: Limited lifetime usage at no cost.
- Developer Plan: A paid subscription that allows you to use your own AI provider API keys.
- Premium: A paid subscription with monthly usage allowances using Umbra's managed AI access.
Current pricing and usage limits for each plan are displayed in the app.
Billing
- Paid subscriptions are billed monthly through Stripe.
- By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
- All prices are in U.S. dollars unless otherwise stated.
Cancellation
- You may cancel your subscription at any time through your account settings or the Stripe customer portal.
- Cancellation takes effect at the end of your current billing period. You retain access to paid features until that date.
- Upon cancellation, your account reverts to the Free tier. Your dream journal data is preserved.
Refunds
- We generally do not offer refunds for partial billing periods.
- If you believe you were charged in error, contact us at support@umbrajournal.com within 14 days of the charge.
5. Developer Plan
If you use the Developer plan:
- You provide your own API keys from supported AI providers (Anthropic, OpenAI).
- You are solely responsible for all usage charges incurred on your API provider accounts as a result of using Umbra. We have no control over and accept no liability for charges billed to you by third-party API providers.
- You are responsible for setting appropriate spending limits with your API provider.
- You represent that you have the right to use the API keys you provide and that your use complies with the API provider's terms of service.
- We store your keys securely to make API calls on your behalf. See our Privacy Policy for details.
- We are not responsible for service interruptions caused by invalid, expired, or rate-limited API keys.
6. Acceptable Use
You agree not to:
- Use Umbra for any unlawful purpose.
- Attempt to access another user's data or account.
- Reverse engineer, decompile, or attempt to extract the source code of the application.
- Interfere with or disrupt the service or its infrastructure.
- Use automated tools (bots, scrapers) to access the service except through our official API, if offered.
- Circumvent usage limits, authentication, or payment requirements.
- Submit content that is illegal, threatening, or designed to harass others.
- Use Umbra to generate content for the purpose of harming or deceiving others.
7. Your Content
Ownership
You own your dreams. All dream journal entries, notes, and other content you submit to Umbra remain your intellectual property. We do not claim any ownership over your content.
License
By submitting content to Umbra, you grant us a limited, non-exclusive license to store, process, and transmit that content solely for the purpose of providing the Umbra service to you. This includes sending dream text to AI providers for interpretation. This license terminates when you delete your content or your account.
AI-Generated Content
Interpretations, pattern analyses, and other outputs generated by Umbra's AI features are provided to you as part of the service. You may use, copy, and share these outputs as you wish. However, AI-generated content is provided "as is" and we make no guarantees about its accuracy, completeness, or suitability for any particular purpose (see Section 1).
8. Intellectual Property
The Umbra application, its design, the Jungian concept graph, branding, and all associated intellectual property are owned by Murray Digital LLC. These Terms do not grant you any rights to our intellectual property beyond the right to use the service as intended.
9. Service Availability
- We strive to keep Umbra available and reliable, but we do not guarantee uninterrupted service.
- We may perform maintenance, updates, or modifications that temporarily affect availability.
- We rely on third-party services (Supabase, Stripe, Anthropic, OpenAI, Vercel) and are not responsible for outages caused by those providers.
- We reserve the right to modify, suspend, or discontinue the service (or any part of it) at any time. If we discontinue the service entirely, we will provide reasonable notice and the opportunity to export your data.
10. Disclaimer of Warranties
Umbra is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
- We do not warrant that AI-generated interpretations are accurate, complete, or suitable for any purpose.
- We do not warrant that the service will be uninterrupted, error-free, or secure.
- We do not warrant that dream pattern tracking or symbol analysis reflects objective psychological truth.
- Umbra's interpretations are generated by artificial intelligence and should be treated as one perspective for self-reflection, not as authoritative psychological analysis.
11. Limitation of Liability
To the maximum extent permitted by law, Murray Digital LLC and its owner, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data, profits, or goodwill.
- Emotional distress or psychological harm arising from AI-generated interpretations.
- Charges incurred on third-party API provider accounts (Developer plan).
- Service interruptions or data loss caused by third-party providers.
Our total aggregate liability for any claims arising from your use of Umbra shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Murray Digital LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the service.
- Your violation of these Terms.
- Your violation of any third party's rights, including API provider terms of service (Developer plan).
13. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles.
Informal Resolution
Before filing any formal legal action, you agree to contact us at legal@umbrajournal.com and attempt to resolve the dispute informally for at least 30 days.
Jurisdiction
Any disputes not resolved informally shall be resolved in the state or federal courts located in Ohio. You consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of Umbra after the updated Terms take effect constitutes acceptance.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Murray Digital LLC regarding your use of the service.
